Updated 2026-10-01. These terms cover the Pencils Up: Trivia Night app and its join and TV web pages, from Scrolling Is Evil LLC.

What the app is

Pencils Up gives a host weekly packs of trivia questions, a way to run the night from a phone, and web pages where teams join and answer. Each answer in a pack is checked against two independent sources, and the app shows those sources to the host. A host can still get a question wrong or disagree with a source; the host decides how to mark it at the table. If you find a wrong answer, email support@scrollingisevil.com and we will correct the pack.

Free sample and the subscription

One complete sample pack is free, with no card. Weekly packs need a subscription. The plans and prices for your country show in the app and in your phone's app store before you confirm. In the US the Venue plan is $19.99 per month or $149.99 per year.

• The subscription renews automatically at the end of each period at the price shown when you subscribed, until you cancel.
• Apple or Google charges your store account when you confirm and again at each renewal. Renewal can be charged up to 24 hours before the period ends.
• Cancel any time in your store account settings: on iPhone, Settings, your name, Subscriptions; on Google Play, Payments and subscriptions, Subscriptions. Cancelling stops the next renewal. You keep access until the end of the period you paid for. Deleting the app does not cancel the subscription.
• Restore purchases (in Settings and on the plans screen) brings the subscription back on a phone signed in to the same store account.
• Packs you have already downloaded stay on your phone, but opening packs beyond the free sample needs an active subscription.
• Refunds follow the rules of the store you bought from. For Apple, use reportaproblem.apple.com. For Google Play, see Google's refund page.

Running a night

You are responsible for the night you run: the venue, the players, and following local rules about events and alcohol service. Players join with a room code and team name. Do not use names or answers that are abusive, and the host can remove any team from a room. Rooms close 12 hours after their last activity. Do not try to scan for other people's rooms, overload the server, or copy the packs to redistribute them.

Apple's license

If you got Pencils Up from the App Store, Apple's Licensed Application End User License Agreement also applies.

Your data

The privacy page lists what the app and the room server store.

Limits

The app and the room server are provided as is, and a night can be interrupted by your network, your phone, or ours. To the extent the law allows, Scrolling Is Evil LLC is not liable for lost prizes, lost bar revenue, or other loss that comes from a night that ran badly, and its total liability for the app is limited to what you paid for it in the past 12 months.

Changes

If these terms change, the new text is posted at this address with a new date. Using the app after that means you accept the new terms.
